Overview
A foreign national who is legally married to a Thai citizen may qualify for a Non-Immigrant O visa and, if the applicable conditions are met, an extension of stay based on the marriage. The initial visa and subsequent extension are separate immigration steps.
Who can apply
- The marriage must be legally recognized and supported by acceptable records.
- Applicants must establish the relationship and comply with immigration conditions.
- Rules for spouses, parents and other Thai-family relationships are not identical.
Financial requirements
- For a common annual extension route involving a foreign husband married to a Thai wife, the published requirement is qualifying monthly income of at least THB 40,000 or THB 400,000 held in a Thai bank account for the prescribed period.
- Financial documents, deposit duration and alternative evidence must be checked for the particular case rather than treated as universal for every family circumstance.
Visa validity and permission to stay
A Non-O visa commonly allows an initial stay of up to 90 days. An eligible applicant may seek an extension of stay, often for one year, through the Immigration Bureau. Approval and future extensions depend on continued eligibility. Marriage alone does not grant permission to work; separate work authorization may be needed.
Typical supporting documents
- Passport, photograph and current immigration documents.
- Thai spouse's identification and household registration documents, where applicable.
- Marriage certificate and any necessary registration or translation documents.
- Required bank letter, statements or qualifying income evidence.
- Proof of residence and additional relationship evidence requested by Immigration.
Application process
Confirm eligibility, obtain any needed Non-O visa or immigration status, and prepare the extension documents for the responsible Immigration office. Do not travel outside Thailand on an existing extension without checking whether a re-entry permit is required.
